Terms and Conditions

All MP Gallery Limited products are sold subject to the terms and conditions set out below.

1. Our Website

We will attempt to ensure that the information available on the website at any time is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these.

Whilst we attempt to be as accurate as possible with the specifications of the artwork offered for sale, we cannot be held responsible for any inaccuracies.

2. Acceptance of Order

Your order becomes binding as soon as it has been accepted by MP Gallery Limited, subject to your rights of cancellation (please see section 6).

The product you order will be made bespoke to you in accordance with the instructions and specifications you have given us.

It is your responsibility to check all the details and aspects of your order are correct and that the goods are suitable for your requirements (including product features, measurements, dimensions, delivery and access) when we send through your order acknowledgement email.

MP Gallery Limited is not regulated by the Financial Conduct Authority and is not authorised to offer advice on current and future investment, whether regulated or unregulated. If you are making investment decisions you should seek advice from an independent financial advisor or other regulated professional. Investments in art can go down as well as up. M P Gallery Limited (together with it’s directors and employees) gives no guarantee, warranty or representation as to the investment potential of the goods that it offers for sale.

We have the right to revise and amend these Terms from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities. You will be subject to the policies and terms in force at the time that you order the Goods from us, unless any change to those policies or these terms is required by law or government or regulatory authority (in which case, it will apply to orders you have previously placed that we have not yet fulfilled).

3. Liability

Because our art is made specifically to your order, it is not possible to return it if is not suitable.

If the product you have received is damaged or we have made a mistake with your order we will of course repair or replace it as soon as possible.

It is your responsibility to examine your artwork carefully for any damage and to contact us as swiftly as possible should any defects be identified, in order that we can take the necessary steps to repair, replace, or if necessary refund the goods. We therefore request that upon receipt of your artwork you remove all packaging and inspect the piece closely to ensure that it is in perfect condition. Should you be less than satisfied with the quality of the artwork itself or any aspect of the frame, you should advise us no later than 48 hours after taking possession of the goods. Any delay to you notifying us might impact upon our ability to rectify the issue for you.

We cannot be held liable for conditions of use or storage within the customers’ house after delivery which may affect the product in any way.

We warrant that on delivery and for a period of 7 days from the date of delivery or the date upon which we notify you that the Goods are ready for collection, as the case may be, the Goods shall:

  1. conform in all material respects with their description subject to any qualification or representation contained in the brochures, advertisements or other documentation;
  2. be of satisfactory quality;
  3. be fit for any purpose we represent in writing the Goods are fit for or for any reasonable purpose for which you use the Goods;
  4. be free from material defects in design, material and workmanship; and
  5. comply with all applicable statutory and regulatory requirements for selling the Goods in the United Kingdom.

This warranty does not apply to any defect in the Goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, if you use the Goods in a way that we do not recommend, your failure to follow our instructions, or any alteration or repair you carry out without our prior written approval.

4. Payment

Due to each product being bespoke, 100% of the cost of the goods is taken when your order is placed.

For the avoidance of doubt, the laws in place within the United Kingdom are those that are applied to all contracts for sale. International customers will be responsible for the payment of any applicable import duties and taxes.

All orders are totally refundable up to 48 hours after your order is placed.

Every effort is made to ensure that prices are correct at the time of publication. If an error has been made, we or you may cancel the order subject to the terms indicated under section 6.

We reserve the right to change prices without notice up until the time you have placed your order.

5. Lay Away Scheme

MP Gallery Limited operate a layaway scheme in the gallery, products can be reserved with a deposit with the balance being paid over a 3 month period with an interest rate of 0%. The balance must be paid within 3 months and your purchase can either be collected or delivery arranged. Failure to clear the balance within 3 months of paying the deposit will mean the piece of art can be resold by MP Gallery Limited, and the deposit will be lost. Items will remain the property of MP Gallery Limited until the full balance has been paid

6. Delivery

Each piece of art bought from MP Gallery Limited is made to your individual specifications. This means that it can sometimes take up to 20 working days for your art to be delivered, although we will always try to deliver sooner.

If your product will not be delivered within 20 working days, a customer services representative will contact you.

You may collect the Goods from us or, if specified at the point of order, we can arrange delivery of the Goods to you.

We will take reasonable steps to meet any estimated delivery or collection date specified in the Order or otherwise agreed by us in writing. However, occasionally this date may be affected by factors beyond our control and so cannot be guaranteed. We will let you know if we become aware of an unexpected delay and will arrange a new estimated date with you.

If we are not able to deliver the whole of the Order at one time due to operational reasons or shortage of stock, we may deliver the order in instalments. We will not charge you extra delivery costs for this. If you ask us to deliver the Order in instalments, we may charge you extra delivery costs. Each instalment shall constitute a separate contract. If we are late delivering an instalment or one instalment is faulty, that will not entitle you to cancel any other instalment.

International delivery charges are priced on an individual basis and are subject to change without prior warning. Any changes in shipping costs between the date of ordering and the date of dispatch will be passed on to the customer.

7. Cancellation

Standard and bespoke art is made to your order and therefore personalised as recognised by the Distance Selling Regulations.

If you need to amend or cancel your order for standard or bespoke products, you have the right to do so at any time up to 48 hours after you have placed your order. If you amend your order in any way more than 48 hours after you placed it, we reserve the right to charge you any costs we have incurred in relation to your order. Any order that requires framing, or items made to order will only receive store credit upon cancellation.

We will refund you on the credit card or debit card used by you to pay. If you used vouchers to pay for the Product we may refund you in vouchers. Should you wish to cancel your order before the goods have been received, a refund will only be payable once the item has been returned or recovered within a 2 week period.

Then you must return them to us without undue delay and in any event not later than 7 days after the day on which you let us know that you wish to cancel the Contract. You can either send them back or return them to us in-store. If we have offered to collect the Goods from you, we will collect the Goods from the address to which they were delivered. We will contact you to arrange a suitable time for collection;

If Goods have been delivered to you before you decide to cancel your Contract, unless the Product is faulty or not as described (in this case, see clause 7), you will be responsible for the cost of returning the Products to us. If we have offered to collect the Product from you, at our discretion we will charge you the direct cost to us of collection.

Apart from the special circumstances described above, you may only cancel your order with our agreement. Any deposit held will be used to defray our initial costs and expenses of fulfilment and any remaining deposit (or part of it) will be retained by us to be used as a credit against the purchase of other Goods for the same or higher price. In the case of Goods which we are unlikely to be able to use or sell elsewhere, we may, if we have agreed to a cancellation, also deduct the value of these items from your deposit and ask you to pay any additional amount if their value is more than the amount of your deposit.

Under The Consumer Regulations 2013 you have the right to cancel your order as long as you do so in writing to [email protected] and no later than 14 days after the day on which you receive the goods. However, this right to cancel your order does not apply to Goods which are custom-made or otherwise made to your specification or clearly personalised;

Following cancelling an order, we shall reimburse you any sums that you paid for the Goods in question as soon as possible and, in any case, within 30 calendar days of the day on which you gave us written notice of cancellation, less our costs of recovering the Goods if you fail to pay the costs of returning those Goods to us and subject to you taking reasonable care of the Goods until they are returned to us. If you cancel an order for Goods which we have already processed for delivery, you must not unpack the goods when they are received by you. Goods must be returned in their original packaging.

If you have cancelled your order and the Goods were delivered to you:

o (a) you must return the relevant Goods to us as soon as reasonably practicable. If the Goods require collection, we will arrange to collect them from the address to which they were delivered. We will contact you to arrange a suitable time for collection;

o (b) you will be responsible for the cost of returning the Goods to us or, where relevant, the cost of us collecting the Goods from you; and

o (c) you have a legal obligation to keep the Goods in your possession and to take reasonable care of the Goods until returned to or collected by us.

8. The Goods

In accordance with your statutory rights, on delivery or the date upon which we notify you that the goods are ready for collection, as the case may be, the goods shall:

  • Conform with these terms;
  • Conform in all material respects with their description and which match any sample or model seen or examined by you, subject to any qualification or representation contained in the relevant brochures, advertisements or other documentation;
  • Be of satisfactory quality;
  • Be fit for purpose for use as indoor display artwork;
  • Be fit for purpose for use as outdoor display artwork where the description of the goods makes it clear that the goods can be displayed outdoors or if we have confirmed in writing that the goods can be displayed outdoors; and
  • Comply with all applicable statutory and regulatory requirements relating to the selling of such goods in the United Kingdom.
  • For further advice about your statutory rights, including those set out in clause
  • please contact your local citizens’ advice bureau or trading standards office.

It is your responsibility to examine your goods carefully for any damage and to contact us as swiftly as possible should any defects be identified on delivery, in order that we can take the necessary steps to repair, replace, or if necessary, refund the goods. We therefore request that upon receipt of your goods you remove all packaging and inspect the goods closely to ensure that they are in good condition. Should you be less than satisfied with the quality or condition of the goods or any aspect of the frame (if applicable), you should advise us no later than 14 working days after taking possession of the goods. Any delay to you notifying us might impact upon our ability to rectify the issue for you. This clause 3.4 does not affect your statutory rights.

9. Returns

Our bespoke products cannot be returned after you have received them unless they are confirmed as defective or damaged.

For non-bespoke products, please let us know within 48 hours after delivery or collection. We will ask you to return the Goods to us or (at our option) arrange collection and once we have checked that the Goods are damaged or defective, we will either (at our option):

  1. provide you with a full or partial refund (including refund of any reasonable delivery charges which you have incurred); or
  2. replace the Goods; or
  3. repair the Goods.

Goods will not be accepted for return unless we are reasonably satisfied that they are damaged or defective. Any bespoke product that is returned but which is not faulty or defective will be subject to a minimum restocking charge of 20% of the retail price.

All sculptures must be returned in their original packaging

Should you wish to return any items for a refund, if purchased in conjunction with the initial sign up discount codes, any discount applied at the time of purchase will be revised and applied in line with the value of the remainder of the order.

These Terms will apply to any replacement Goods we supply to you.

Please note that no claims will be accepted in respect of any changes in colouring of artworks which have occurred through natural processes.

10. Access

It is your responsibility to ensure that the product you have ordered will fit into your home. It is very important that you carefully measure where the piece is going to go and also whether we can get it to the location. Please be sure to check these details in advance of placing your order.

11. Colour & Anomalies

Although we are confident that our production process produces limited edition art that is as closely matched to the original product as possible, goods may not appear the same colour as shown on the website.

Within acceptable limits, there may occur blemishes in our frames - such as small knots - which can only be considered a naturally occurring phenomena and therefore not considered defective in any way.

12. PROTECTING YOU

Data Protection

MP Gallery Limited takes the security of your personal and financial information very seriously. We do not retain, in full format, any details of your credit card post payment. We shall not pass on your personal information to any third party organisation unless legally demanded to do so by a warranted entity or body.

If at any time you do not wish to continue receiving communications from MP Gallery Limited, we are more than happy to remove these from our database. In such circumstances, only written correspondence requesting deletion shall be actioned against.

14. Consumer Act 2013
